BansGhari operates as a marketplace and is not directly involved in the transactions between the Users and the Sellers. As a result, BansGhari has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of Sellers to sell items or the ability of Users to pay for the Products. We reserve the right to change these Terms at any time. Such changes will be effective when posted on the Website and may, at the sole discretion of the Website be notified to the Users from time to time.

Terms of Sales

By placing an order, you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

(a) Our Contract

A contract between us will not be formed until we send you confirmation by either e-mail or phone call that the products which you ordered have been consigned to you.

(b) Pricing and Availability 

Prices (inclusive of VAT) are displayed in Nepalese currency. While we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this asap and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. However, the prices and availability of products are subject to change without prior notice.

(c) Payment

Payments can be done through Bank Deposit and/or Cash on Delivery. Upon receiving your order, we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. After we confirm that your order will be processed. However, we will not be responsible for any payments that are not received in our bank account.

(d) Coupons/Gift Vouchers

Users using coupons/gift vouchers should note that such coupons neither carries any cash value nor can be redeemed, transferred, negotiated or sold against cash. Gift vouchers are issued from time to time for promotions in our discretion.

(e) Return / Exchange

The goods are delivered to the customers. Within the very duration they need to declare that they are going to keep it or not. Unfortunately, we will not be able to offer you an exchange after the day we delivered.

(f) Delivery

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

(g) Order Cancellation

If we receive your cancellation order after we have already processed your delivery order, you may be charged with 50% of your ordered price.

Disclaimer as to ownership of trade marks, images of personalities and third party copyright except where expressly stated. Any trade marks/names featured on this Website are owned by the respective trademark owners.

Variation

We shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the products and services and/or any page of this Website. The same products will be delivered to you as seen on the website/ on your monitor. However, it may slightly vary in appearance, design and color.

These terms and the other policies posted on BansGhari constitute the entire agreement between BansGhari.com and you, supplanting any conflicting parts of any prior agreements. We may automatically assign this agreement in our sole discretion in accordance with the notice provision. We will send notices to you via the email address that you provide, or by registered mail to the address you provide. We may update these terms at any time, with updates taking effect 35 days after they are initially posted on the Site. No other amendment to these terms will be effective unless made in writing, signed by users and by us.
